What is Insurance Fraud?

Insurance fraud involves deliberately providing false information to obtain a benefit or advantage one is not entitled to or denying someone a rightful benefit. In New Jersey, suspected insurance fraud cases are referred to the state and can be prosecuted as felonies. Penalties for insurance fraud can include probation, fines, community service, restitution, and imprisonment. According to the law, insurance fraud can be prosecuted if:

  • Intent to Defraud: The suspect must have knowingly intended to commit fraud.
  • Completion of an Act: Making a false statement (written or oral) to an insurer with the knowledge of its falsity is sufficient.
  • Convergence of Act and Intent: Both the act and intent must coexist for it to be considered a crime.
  • No Need for Actual Loss: A crime can still be prosecuted if the act and intent are present, regardless of whether any monetary loss occurred.
